Client Agreement

This Client Agreement ("Agreement") constitutes a legally binding contract between Fairoaks ("Company", "we", "us") and the account holder ("Client", "you"). This document governs the terms under which we provide trading accounts, platform access, and financial services.

1. Scope and Introduction

By opening an account, completing verifications, depositing funds, or accessing our services, you agree to follow the terms of this Agreement and our related policies (including the Privacy Policy, Terms & Conditions, and Risk Disclaimer). If you do not agree to these terms, you must not access or use our services.

2. Account Registration and Management

  • Accuracy of Information: You must provide complete, accurate, and truthful details during registration. You agree to notify us immediately of any updates to your identity or financial status.
  • Single Account Policy: Clients are restricted to opening and operating one main trading account. Multiple profiles detected under identical ownership will be consolidated or suspended.
  • Security of Credentials: You are solely responsible for securing your profile passwords and MT5 trading codes. Any trade executed with your credentials will be deemed authorized by you.

3. ECN Trading Services

We provide retail and institutional ECN (Electronic Communication Network) market access. Order execution is processed using true liquidity matching with zero markups or interference. While we make every effort to execute orders at your selected price, market volatility can result in slippage or unfilled orders, which we are not responsible for.

4. Deposits and Withdrawals

  • Funding Methods: Deposits must be made using verified payment methods registered in your own name. Third-party deposits are prohibited and will be rejected.
  • Withdrawal Requests: Withdrawals are processed back to the original deposit source where possible. Processing is subject to manual security reviews and can take up to 2-3 business days.
  • Fees: We do not charge fees for standard deposits. Withdrawal fees depend on the chosen payment method and are detailed in our published fee schedule.

5. AML and KYC Compliance

To comply with Anti-Money Laundering (AML) standards, all accounts must submit proof of identity (passport, national ID card) and proof of address (utility bill, bank statement). We reserve the right to audit transactions, request source of wealth verifications, and freeze accounts if illegal activities are suspected.

6. Default & Account Termination

We reserve the right to close your account and cancel active trades without notice in the following events of default:

  • Failure to complete mandatory identity verification checks.
  • Suspected fraud, platform hacking, or unauthorized system manipulation.
  • Violation of any local or international financial regulation.

Upon termination, any remaining balances, excluding outstanding fees, will be returned to your verified bank account or wallet.

7. Indemnity & Limitation of Liability

You agree to indemnify and hold harmless Fairoaks and its directors, employees, and partners against any claims, losses, or liabilities resulting from your use of the platform, your trading decisions, or your breach of this Agreement.

8. Governing Law & Jurisdictional Disputes

This Agreement, along with all financial transactions and disputes between the Client and Company, will be governed by and interpreted in accordance with applicable corporate regulations. Any legal actions will be resolved under the jurisdiction of designated courts.
